In some cases, oil and gas disputes can lead to serious lawsuits that put companies in the position of having to defend their uses and business practices. Unfortunately for those companies, these disputes are not uncommon.

California readers may be interested in disputes involving Exxon Mobil Corp. According to reports, the company is accused of providing false information to investors regarding the impacts that emissions can have on the climate. Claims indicate that the company knew about the possible damage since 1977 and have covered up the information presumably for company gain. Exxon, however, denies those claims.

The company is currently facing lawsuits in multiple states, and those suits focus on the alleged deception that Exxon Mobil has carried out in efforts to cover up negative impacts of fossil fuel use. However, the company indicated that the claims are politically motivated and without merit. The company plans to defend against the allegations as the cases move forward. The report also stated that three other lawsuits against over a dozen oil and gas companies were allowed to move forward by the Supreme Court.

Any business can face accusations from outside parties who believe that the businesses are not operating honestly. As this report shows, oil and gas disputes can be far reaching, and companies can have a lot on their plates when it comes to defending against negative claims. If companies in California are facing such allegations, they may want to discuss their available options with their legal counsel.

Of course, it can be complicated to lease land in order to drill, and it is important that any oil and gas transactions are carried out properly. As a result, when individuals hear of land opening up for drilling, they may want to look into their options.

It was recently reported that 725,000 acres in California have been opened up for drilling. The land, which includes parts of the Central Valley and Central Coast, has been off-limits to drilling since 2013, but the Bureau of Land Management recently issued the decision to allow the leasing of plots in those areas. Though the land is open for lease, the BLM indicated that additional approval would have to be obtained before any drilling could occur.

It was noted that this is not the first time that the land has had the potential to be opened for drilling. The previous presidential administration had attempted to open the land but was blocked by environmentalists. Those same environmentalists are criticizing this new decision, and plans are in the works to fight the outcome.

Though some may view this decision as a negative one, others may be ready to obtain leases on the California land. Interested individuals and businesses may have a lot to go through to obtain a plot, and it is wise to have assistance at this time. Parties may want to reach out to attorneys experienced with oil and gas transactions for advice and support.

These disputes can become more complicated and frustrating as time passes, which is one reason why oil and gas companies faced with a dispute should try to handle these disagreements in a timely manner. Not to mention, these disagreements can be very difficult in terms of time, money and energy. Finding a favorable resolution as soon as possible is very important and can help minimize the damage of a dispute.

There are a number of ways in which oil and gas company owners may be able to resolve these disputes in a more timely fashion. For starters, if they are able to communicate with the parties involved, this can get rid of confusion and lead to a more amicable experience. Moreover, oil and gas company owners should carefully explore their rights as well as the legal strategies that may work best. Having a good understanding of which steps to take when handling a dispute, especially if it ends up in the courtroom, can expedite the process.

Sometimes, these disputes simply cannot be resolved in a timely manner and they drag on. Regardless, it is still very important to keep a close eye on various strategies that could not only increase the odds of an ideal outcome but lessen the burden of a disagreement. We cover many other issues that are related to these disagreements on our website.

One way they can do this is by developing a strong business strategy that is able to withstand the ebbs and flows of the economy without compromising key components of organizational structure.

This is where the idea of a platform strategy comes into play, which is an innovative way to combine technology and data management to optimize the use of valuable information within the oil and gas industry. An interesting statistic for people to note is that multiple terabytes of information are generated by a single oil rig in just one day. If there was a way to condense this information and store it in one place where it could be shared amongst applicable parties, the outcome could be a compilation of data, rich with crucial information that can be used in predicting success and identifying areas of change.

Experts recommend that this seemingly far-fetched idea can actually be achieved and that some oil and gas producers are already moving in this direction by optimizing how they collect, store, disseminate and preserve data. Platforms should be built incrementally so that producers can actively identify the areas of their business that would benefit the most from an efficient transfer of data. They should also incorporate analytics to effectively track various metrics that can be used in strengthening their influence.

When producers are working toward building their assets, an attorney can be a helpful person to have on their team. Experienced legal professionals understand the risks and challenges of operating within such an industry and can be instrumental in helping producers protect the foundation of their success.

Source: Forbes, "How Oil And Gas Can Benefit From The Platform Economy," Lital Marom, Sept. 27, 2019

At Ehrlich • Pledger Law, LLP, we have considerable experience helping clients navigate complex oil and gas issues, and we have helped many of them work through complicated lease negotiations and find solutions that best accommodate their needs.

According to SmallBusiness.Chron.com, one of the first things you should do during oil and gas lease negotiations is make sure you have a solid and comprehensive understanding of everything outlined in the lease. It will generally serve you well for the lease to be highly specific in terms of what a company can extract from your land. You also need to understand exactly where and how a company plans to drill, as well as what its rights are when it comes to any water found on your land during the drilling process.

You should also check to ensure that your lease outlines how, exactly, the company looking to access your minerals plans to do so. Does it plan to build an access road that cuts through part of your land? What does it plan to do with the equipment and pumps used to extract minerals from your land once it completes its efforts?

Often, other sections of oil and gas leases address royalties, shut-in royalties and delay rentals. You may, for example, want to include language concerning what would happen if the oil or gas company fails to start drilling immediately, but still wants an interest in your land. You can find out more about your mineral rights on our webpage.

It is natural for nerves to get frayed when this much is at stake.

Nevertheless, it often takes a level head to go through gas and oil lease documents with an eye for detail. Even relatively common forms of these leases often contain — or could benefit from, for that matter — language that pertains specifically to the deal in question.

We attempt to make sure our clients understand the deal they are entering. We do this by looking at every detail of these documents and communicating these details in as simple and straightforward a manner as possible.

If it turns out that the document was not representative of a negotiated agreement, we also act as representatives in various types of disputes. whether these are internal partner disputes in oil companies or conflicts between buyers and sellers, we bring the same tenacity and attention to detail.

With everything that is at stake with oil and gas contracts, you want to truly understand anything you sign. We believe that our straightforward explanations help our clients do just that.

Your opportunity probably involves a unique set of circumstances. The risk of oversupply can affect the stability of many oil producers in California as well as across the country. With the importation of oil and gas from other countries, it is critical to keep an eye on local oil companies and how this can affect their ability to survive.

Although the market is expected to be volatile in price and production, experts are seeing a trend that local U.S. producers will be able to overcome any challenges this may bring. A contract between the U.S., the Organization of the Petroleum Exporting Countries and Russia says that limited supplies will be sent to the U.S. from these foreign regions. This will give local industries a better chance to control prices and will reduce the threat of oversupply in the U.S.

The demand for oil will also help to control the industries threat of oversupply. Oil and gas usage in the U.S. increased by 2.5% in 2018 from what was used in 2017. With an increase in demand and a limited overseas supply of oil and gas, it is expected that U.S. will survive short-term issues and come out on top.

This information is intended to educate and should not be taken as legal advice.

At Erhlich Pledger Law, LLP, we have considerable experience helping people to make strategic decisions when they are working with oil and gas transactions.

As with anything, there are more appropriate times than others to consider selling your royalties to someone else. Deciding when to begin soliciting your royalties is a matter of how much you wish to get for them, the condition of the market, the appeal of the royalties you are selling and how willing you are to spend time finding an ideal buyer.

According to ILOS Resources, if you are approached about selling your royalties and the discussion is contingent on your willingness to deposit a bank draft, take a step back and reassess. Before you agree to anything, make sure you understand the value of your royalties, as well as how much you are willing to negotiate. Once these decisions have been made, a bank draft can be created. Otherwise, you will compromise your option to negotiate at all. You may also consider getting a few quotes about how much your royalties are worth so you can begin to create boundaries for your selling experience.

When you are equipped with strategic methods for selling your royalties, you may be more confident as you prepare to sell your assets. If you own land or mineral rights, you probably work with those who hold interests or leases in the minerals, mining rights or royalties. Normally, contracts with these individuals and companies could provide consistent value to you as an owner. However, things do not always go as smoothly as intended.

Generally speaking, you can prevent many mineral disputes by establishing sound and fair contracts at the outset of a business partnership. Here is some information about establishing lasting royalty agreements, including some typical industry conventions on pricing.

You would want to negotiate leases that included royalty rights if you owned mineral rights to a piece of property. This allows you to receive payment based on the productivity of your assets as well as their inherent or prospective value. Most royalty rights holders negotiate for somewhere between 1/8 and 1/4, but your own terms should depend on your unique situation.

Of course, the simple percentage of royalty payments is not the only issue at stake. The form of the royalties, such as in-kind or cash, also could determine the value you would be able to secure from the types of payments. In terms of disputes, due dates and interest rates for royalty payments could also come into play. The best strategy in most cases is to go through all of the possibilities and write terms of the contract to deal with them specifically.

If you are receiving royalties, you may suspect that the gas companies are not paying you your due. As discussed on NPR, there are class-action suits in progress against predatory organizations. However, this is just information. Please do not view it as legal advice.
